1. Acceptance of Terms

By accessing or using MACD Trader ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MACD Trader is an automated trading tool that connects to your Alpaca brokerage account to execute trades based on MACD momentum signals. The Service is provided on an invite-only basis.

3. Brokerage Relationship

MACD Trader is not a broker-dealer, investment adviser, or financial institution. Your brokerage account is held at and managed by Alpaca Securities LLC. All trades are executed through your Alpaca account subject to Alpaca's terms and conditions.

4. No Investment Advice

The Service does not provide investment advice, recommendations, or solicitations. Trading signals are generated algorithmically and are not personalized financial advice. You are solely responsible for all trading decisions made through the Service.

5. Risk Disclosure

Trading securities involves substantial risk of loss. Past performance does not guarantee future results. You may lose some or all of your invested capital. You should only use funds you can afford to lose. By using the Service, you acknowledge that:

• Automated trading strategies can and do lose money
• Technical failures, market conditions, or software bugs may result in unintended trades or missed opportunities
• The Service may experience downtime, errors, or interruptions
• You are responsible for monitoring your account and positions

6. Account Access

By connecting your Alpaca account, you authorize the Service to access your account information and place trades on your behalf according to the automated strategy. You may revoke access at any time through your Alpaca account settings.

7. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, MACD Trader and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, or data loss, arising from your use of the Service.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. You may stop using the Service at any time by revoking OAuth access through your Alpaca account.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law provisions.
